This Terms of Use Agreement (the “Agreement”) describes the terms and conditions applicable to your access and use of the website, the carbon credit dashboard, the associated APIs, the RSS feeds and without limitation any other content hosted on the website www.earthonly.io (collectively “the Platform”).
- These terms of use should be read together with the Privacy Policy. By agreeing to these terms, you acknowledge that EarthOnly may collect, use and disclose your information as described in our Privacy Policy available on the Website.
- This Platform is the sole and exclusive property of EarthOnly (owned and operated by Carbisure Tech Private Limited) and/or its licensors. You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purpose, any portion of the Platform or the Content other than as expressly authorized by EarthOnly in writing.
- If you express interest in products or services through your use of the Platform, you consent to EarthOnly sending commercial electronic messages (including messages about EarthOnly products and services and the products and services of third parties) to electronic addresses which you have provided to EarthOnly. You also consent to be contacted by EarthOnly or its authorized affiliates on the contact number provided by you.

- If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please contact us at hello@earthonly.io and provide a description of the copyrighted work or other intellectual property that you claim has been infringed; a description of where the material that you claim is infringing is located on the platform; a signed statement by you that the information provided in your Notice is accurate and that you are the copyright or intellectual property owner or licensee or authorized to act on the copyright or intellectual property owner’s or licensee’s behalf. (Please mention “IPR Infringement” in the subject line)
- You may not link the homepage or any other parts of the Platform without prior written consent from EarthOnly. Unless stated otherwise on the platform, EarthOnly has: (i) no relationship with the owners or operators of those linked website; and (ii) no control over or rights in those linked websites.
- As you browse through our Platform, you may access other websites/links/portals that are subject to different terms of use. When using these other websites/portals, you will be bound by the terms and conditions posted on those links.

- These terms of use and any dispute, controversy, proceedings or claim of whatever nature arising out of or in any way relating to these terms of use, the refund policy or the privacy policy shall be governed by and construed in accordance with Indian law and the courts of Gurugram shall have exclusive jurisdiction to resolve any disputes relating to these terms of use. Any cause of action or claim you may have with respect to this Agreement or the Platform shall be barred if commenced after six (6) months after the claim or cause of action arises.
- EarthOnly reserves the right to seek all remedies available at law and in equity for violations of this Agreement and/or the rules and regulations set forth on the Platform, including without limitation the right to block access from a particular internet address.
- If any provision of this Agreement is held to be illegal, invalid or unenforceable, such provision shall be disregarded and the remaining provisions shall remain in full force. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section.
